Terms of Service
Last updated
These terms are the agreement between you and StackerMint LLC for using StackerMint, on the website and in the app. Please read them. They are written to be understood, not to be skimmed past.
1. Who we are
StackerMint is run by StackerMint LLC, a Florida company in the United States. In these terms, "StackerMint", "we" and "us" mean StackerMint LLC, and "you" means the person using StackerMint. You can reach us at support@stackermint.com.
2. Agreeing to these terms
By creating an account or using StackerMint, you agree to these terms and to our Privacy Policy, which explains what we collect and why: https://stackermint.com/privacy. If you do not agree, please do not use StackerMint.
3. Who can use StackerMint
- You must be 18 or older.
- You must live in the United States.
- An account is for one person. Do not share it or create one for someone else.
- You may not use StackerMint if we have closed your account before for breaking these terms, or if the law does not allow you to.
4. Your account
Keep your password, passkeys and two-factor codes safe. You are responsible for what happens on your account. If you think someone else has got into it, change your password and tell us at support@stackermint.com straight away. Keep your email address current, because that is how we reach you about your account and about changes to these terms.
5. What is free and what may cost money
Tracking your collection on StackerMint is free, and it always will be.
We may introduce paid tools for sellers, and fees on sales made through StackerMint. No new fee or paid tool will apply to you until we have emailed you about it at least 14 days before it takes effect. Anything that costs money will say so, with the price, before you use it. Nothing you already use for free will start charging you without that notice.
6. Selling and recording sales
If you sell through StackerMint, or record a sale you made elsewhere, the sale is between you and the buyer. You are responsible for describing the item honestly, for delivering it, and for any taxes. StackerMint is not a party to the sale. Payouts to sellers are handled by Stripe. To receive them, you accept Stripe's Connected Account Agreement, and Stripe's terms also apply to you. Full terms for selling will be added here before buying on StackerMint opens.
7. Your content, photos and videos
You own what you add to StackerMint: your collection records, your notes, your photos and videos, and your public profile.
So that we can run the service, you give us a licence to store, copy, display and process what you add, for your own account and on any page you choose to make public. This licence is worldwide and free of charge, and it ends when you delete the content or your account, except for copies we must keep as described in the Privacy Policy.
You also give us a permanent, worldwide, free licence to use your photos, without your name, as reference images in the StackerMint catalog, so that other collectors can see what a coin or note looks like. A photo used this way never carries your name, your profile or anything else that points to you. There is no opt-out from this use, and it continues after you delete a photo or your account. If that does not suit you, please do not upload photos.
We do not use your videos this way. They are shown only in your own account and on pages you choose to make public.
You promise that you have the right to add what you add, and that it does not break the law or anyone else's rights.
8. Your public profile
Your collection is private unless you choose to make something public. If you turn on a public profile, the things you choose to show on it can be seen by anyone, including people who are not signed in, and search engines may find it. You can change what it shows, or turn it off, at any time on your Public profile page, on the website or in the app.
You are responsible for what you put on your public profile. We do not allow objectionable content or abusive behavior on StackerMint, and we have zero tolerance for either. That includes content that is hateful, harassing, threatening, sexually explicit, violent or misleading, and anything that pretends to be someone else.
If you see something on StackerMint that breaks these terms, use Report in the ⋯ menu on that member's profile, or email us at support@stackermint.com. We review every report and act on it within 24 hours. When a page is reported, we keep a copy of it as it looked at that moment, so we can review it fairly. We may remove content, hide a profile, or suspend or close the account behind it, with or without notice.
You can also block a member. Their profile and its pages are then hidden from you. They are not told. You can unblock them at any time under Settings → Blocked collectors.
9. Values and prices are information, not advice
StackerMint shows values and prices from outside sources, such as PCGS, Greysheet and live spot prices for precious metals, along with values you enter yourself. We show them as we receive them. They can be wrong, incomplete or out of date.
They are for information only. They are not appraisals, not financial or investment advice, and not an offer by anyone to buy or sell at that price. What a coin or note is actually worth depends on the piece and the buyer. Check before you rely on a figure for a purchase, a sale, insurance or taxes.
10. Using StackerMint fairly
When you use StackerMint, you agree not to:
- break the law, or help anyone else do so;
- present a counterfeit, altered or misdescribed coin, note or bullion item as genuine;
- pretend to be another person or business, or misrepresent your connection with one;
- harass, threaten or abuse anyone;
- copy, scrape or harvest data from StackerMint by automated means, or use it to build a competing product;
- try to get into accounts or systems that are not yours, test our security without our written permission, or interfere with how StackerMint runs;
- copy, change or reverse-engineer the app or the website, except where the law allows it;
- use anyone else's personal information without their permission.
11. Copyright complaints
We respect copyright and expect members to do the same. If you believe something on StackerMint infringes your copyright, send a notice to our designated copyright agent:
Michael Francik, Copyright Agent, StackerMint LLC
5947 NW 65th Terrace, Parkland, FL 33067
Phone: (954) 547-4721
Email: mike@stackermint.com
Your notice must include:
- the work you believe is being infringed;
- where the material is on StackerMint, such as the page address;
- your name, address, phone number and email address;
- a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law;
- a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner;
- your physical or electronic signature.
If we remove material because of a complaint, we will tell the member who posted it, and they may send us a counter-notice. We close the accounts of members who infringe repeatedly.
12. Email from us
We send you email you need to use your account, such as sign-in links, security notices and notices about these terms. You cannot turn those off while you have an account.
What checking the box means
Some parts of StackerMint, such as auction alerts, offer a box you can check to hear from us. Checking it means you agree to two things:
- The alerts you asked for, about what you signed up to follow.
- Occasional marketing email — other auctions and coins we think you'd want to see.
Every email carries a one-click unsubscribe. Click it and you're out — immediately, no login, no questions.
13. Ending your account
You can delete your account at any time, in Settings, on the website or in the app. What we delete and what we must keep, and for how long, is set out in the Privacy Policy.
We may suspend or close your account, or remove content, if you break these terms, if the law requires it, or if your use puts other members or StackerMint at risk. Where it is safe and lawful to, we will tell you why.
The sections on your content and photos, values and prices, the service being provided as-is, limits on our liability, and disputes still apply after your account ends.
14. The service is provided as-is
We work hard to keep StackerMint running and accurate, but we provide it "as is" and "as available". As far as the law allows, we give no warranties of any kind, whether express or implied, including that StackerMint will always be available, free of errors, secure, or fit for a particular purpose, or that any value, price or catalog detail is correct.
We may change, add or remove features at any time. Please keep your own records of anything you cannot afford to lose.
15. Limits on our liability
As far as the law allows:
- we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or lost value, arising from your use of StackerMint, even if we were told they were possible;
- our total liability to you for all claims about StackerMint is limited to the greater of $100 or the amount you paid us in the 12 months before the claim arose.
Some states do not allow some of these limits, so they may not all apply to you. Nothing in these terms limits liability that the law does not allow us to limit.
16. Disputes and governing law
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules.
If you have a problem, please write to us first at support@stackermint.com. Most problems can be fixed that way.
If we cannot resolve it, either of us may bring a claim in the state courts located in Broward County, Florida, or in a small claims court that has jurisdiction. You and we agree to those courts' jurisdiction.
17. The app and app stores
If you downloaded the StackerMint app from Apple's App Store, these extra terms apply:
- These terms are between you and StackerMint LLC, not Apple. Apple is not responsible for the app or its content.
- Your licence to use the app is a personal, non-transferable licence to use it on Apple devices that you own or control, as the App Store's Usage Rules allow.
- Apple has no obligation to provide maintenance or support for the app. Questions go to us at support@stackermint.com.
- If the app fails to meet a warranty that applies by law, you may tell Apple, and Apple will refund the purchase price, if any. Apple has no other warranty obligation for the app, as far as the law allows.
- StackerMint, not Apple, is responsible for any claims about the app, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If anyone claims the app or your use of it infringes their intellectual property, StackerMint, not Apple, is responsible for dealing with that claim.
- You confirm that you are not in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
- You must also follow any third-party terms that apply when you use the app, such as your mobile carrier's.
- Apple and its subsidiaries are third-party beneficiaries of these terms, and once you accept them, Apple may enforce them against you.
If you downloaded the app from another app store, such as Google Play, that store's terms also apply to your download, and these terms govern your use of StackerMint.
18. Changes to these terms
We may update these terms. The date at the top always shows when they last changed. If a change is material, we will email you before it takes effect. If you keep using StackerMint after a change takes effect, you accept the updated terms. If you do not, you can delete your account.
19. Everything else
These terms and the Privacy Policy are the whole agreement between you and us about StackerMint. If a court finds part of these terms unenforceable, the rest still applies. If we do not enforce part of these terms straight away, we have not given up the right to. You may not transfer these terms to anyone else; we may transfer them if StackerMint LLC is sold or reorganized.
